According to the U.S. District Court website for the Northern District of California, Judge Vaughn Walker will issue his decision on Wednesday, Aug. 4 in the Proposition 8 trial:
On August 4, 2010, the court will issue its written order containing findings of fact and conclusions of law following the court trial held in January and June of this year. The order will be e-filed in the court’s Electronic Case Filing system, and will be immediately available thereafter through ECF and PACER. There will be no court proceeding associated with the publication of the order.

UPDATE No. 3: The ruling is expected to be issued between 1 p.m. and 3 p.m. Pacific time, which is 3 p.m. and 5 p.m. Dallas time.
UPDATE No. 4: The anti-marriage equality folks have filed a motion seeking a stay if Judge Walker strikes down Prop 8. Such a stay would presumably mean that same-sex marriages could not be performed pending the appeal of Walker’s decision. Our sources indicate that it’s likely Walker will grant this stay. If he strikes down Prop 8 and doesn’t grant the stay, the anti-gay marriage side would immediately request a stay from the appeals court, which also would likely be granted. In other words, it’s unlikely that marriages will be performed Wednesday or anytime in the near future.
Why have a rally? Nobody will know what it’s about AND this ruling will be appealed.

Why have a rally? Because we count as human beings. . . and if there are enough rallies and enough of the community talk about it, people will know!
Instead of fighting backwards and forwards every few months or years, you folks in the USA should be fighting for Constitutional protection of ALL human and civil rights so that UNCONSTITUTIONAL motions and bills which violate civil rights and the constitution fail at the outset.
Wednesday is a big day no matter what comes down. Proposition 8 is finally going to Washing DC either way and this is a big step forward for human rights. It’s amazing how “not” important this is if you can marry the one you love….but for others that are denied that right…..it is major.
Court rulings are not history. Clearly this judge has no final say in the matter.
How is a marriage equality rally on Cedar Springs anything more than preaching to the choir? It’s not exactly a bold move to hold this in the middle of the gayborhood. We of course need to take action either way but why stick to where most everyone will agree with us anyway?

Yes we need to rally, I rally all the time. I express my feelings in the workplace, around straight friends just anywhere where I can maybe change a mind. A rally can start with one in a small crowd.
