As we get ready to crank up our Election Night live blog, I wanted to quickly report some mild drama at my voting precinct, the Bethany Church on Cedar Springs Road, where I just cast my ballot. As I was in line, the election judge was on the phone with law enforcement asking them to come remove a Tea Party activist who’d set up shop outside waving his “Don’t Tread on Me” flag. Campaigning is prohibited within 100 feet of a polling location, and the election judge felt this was a violation. The Tea Party activist, however, reportedly was arguing that as long as he was in a public right of way (the sidewalk) and kept moving, he was legal. I didn’t stick around to find out what happened, but I did go over and try to talk to the guy before I left. He refused comment and asked me not to take his picture with my phone, but I did anyway. Sorry, Tea Party guy, you were on a public sidewalk, and you can’t have it both ways.

He moved across the street and was marching back and forth about 1/2 hour ago (7pm now)
“arguing that as long as he was in a public right of way ” Hmm this sounds very familiar I thnk this happened in Southlake last election and the person was arrested I believe, wonder if its the same guy. They wont be happy untill we have to push by them on the way to vote. Perhaps their attempting to chalange the 100ft using free speech as their trojan horse. Or he’s just stupid.
