Rabid anti-gay Virginia AG not giving in
Virginia Attorney General Ken Cuccinelli is not giving in on removing sexual orientation from the non-discrimination policies of the state universities.
We reported that Cuccinelli ordered the Virginia state universities to remove language from their policies and that Gov. Robert McDonnell reversed that decision with his own order.
According to the Washington Post, McDonnell issued an executive directive, which is not legally binding. Cuccinelli said that state law doesn’t cover sexual orientation and only the General Assembly can change that.
Equality Virginia called on the governor to appoint a special counsel to enforce his directive and to push for changes to the state’s law.
Likewise the rabid HomoNazi’s and the rabid NewsNazi’s are not giving in. They both constitute a very small number speaking very LOUDLY, always looking for a foot to step on and a face to stick their behinds in.
Religion and politics have never made truly good bed fellows. This is why
it was made clear as a matter of law via Article VI of the constitution
and the Treaty of Tripoli …”As the Government of the United States of
America is not in any sense founded on the Christian religion”…
That’s also why we have the 1st Amendment establishment clause of the constitution.
That being said , religion is a matter between each individual and their beliefs
that they should have to justify to no man.
The problems occur when we try and violate the nature of our constitution
by mixing religion and government. It’s bad for religion and it’s bad for the nation.
As the story goes , Jesus was taken to a high mountain by Satan and offered power
over all the nations if Jesus would but perform an act of worship to Satan.
Jesus declined the offer , and so should religious followers.
There are many in politics that would like to take religious followers to the mountain
by whatever means possible.
Mary and AG Cuccinelli are buggy whips.
“Rabid” and “anti-gay”? I don’t know the background, but from the story, it’s apparent that everyone acknowledges the law doesn’t actually cover sexual preference; otherwise the “Equality Virginia” organization wouldn’t be calling for the law to be changed. So the AG is saying nothing more than that the university “policy” should conform to the actual law. That’s “rabid” and “anti-gay”? I guess logic doesn’t matter if the wrong people are offended.

If there is a law against having protections for sexual-orientation then they would be a violation
of the 1st Amendment’s establishment clause, as any such law would find in it’s
basis and promotion , religious doctrine.
If there is no law against having protections for sexual-orientation then there is nothing
wrong with the university upholding the constitution of the United States of America by
fostering equal protection for all.
Our country’s constitution is deliberately a secular one , and not a theocracy
and certainly as a matter of law not founded on Christianity. That’s been the
law of the land since the time of George Washington, no matter what FNORDs
one might have been fed.

While your reading up on the constitution , count how many times the word “God”
was allowed into this secular document. I’ll give you a hint ZERO.
Government and religion don’t mix, and our framers still had that fresh in their
minds as laid out the foundations of this country.
Religion is something between each individual and their beliefs, but for
there to be justice for all , those beliefs cannot be codified into law.
Chas, Equality Virginia is backing the directive issued by Governor McDonnell. That directive was meant to override the directive issues by AG Cuccinelli removing sexual orientation from the non-discrimination policies of the state universities.
Read the article just like everyone else did. Logical thing to do don’t you think?
Chas: If you read Cucchinelli’s most-recent op-ed piece, he uses the loaded phrase “specially protected class” to refer to LGBT persons. This is the typical histronics of the far-right, such as Tony Perkins, who argue that what gays want is “special treatment” when in fact, what gays want, is EQUAL treatment under the law.
So the law does not state that you must include sexual orientation in non-discrimination policies. It also does not state that you can’t choose to include them.
The laws are the minimum standard. Having a stronger standard does not invalidate nor go against the weaker one.
For example: on most highways the speed limit is 70. If you as a parent only allow your child to drive 60 that is a valid restriction. Your child is still abiding by the legal speed limit of 70 by sticking to your parental limit of 60.
So as long as everything in the state law is maintained adding additional restrictions should be up to the schools.
I do not believe that the state law expressly permits discrimination against any non-named classes.
We can only hope for a day when the haters are ashamed to spew their homophobic views in public and their only refuge will be the back rooms and anonymous internet forums like the white supremacists are forced to do.
