Secretary of the Army John McHugh said he spoke to a number of gay and lesbian soldiers about “Don’t ask, don’t tell.”
He said they spoke about wanting to serve their country and about being uncomfortable serving under the current law.
McHugh said he will not begin any disciplinary action against any of the soldiers for telling.
Damn nice of him.
But under current law, isn’t the first part “Don’t ask?” And if he asked, isn’t he as guilty as they are for telling?

    The Sec of the Army is actually a civilian position so the DADT law does not apply to him & he can ask whomever he wants whatever he wants. So to answer your question, no he would not be subject to any disciplinary action.
