When 23-year-old Whitney Fox crashed her car into a concrete wall on the Dallas North Tollway near Lemmon Avenue in October 2009, she and her friends were on their way home from a gay bar, according to her attorney.
As you may have heard, what happened next has led to criminal charges against DPS Trooper Arturo Perez, who slammed Fox’s head into said concrete wall after she allegedly resisted arrest on drunken driving charges. The incident is shown in the shocking new video above.
Last night, Fox 4‘s Steve Eagar asked Fox’s attorney, Randy Isenberg, about the gay aspect of the case.
Eagar: “I don’t think many know this, but she was coming home from a party at a gay bar that night. Your client says when she told the officer that, he had some kind of reaction. She thought he didn’t like it. Does she think that’s why what happened happened?”
Isenberg: “I don’t think she’s blaming her friends that were with her’s orientation for the officer, but she did indicate that there was a change in his demeanor when he learned that.”
Eagar: “Has that been part of the investigation, do you know?”
Isenberg: “Well I don’t really know.”
Eagar: “The FBI investigated?”
Isenberg: “The FBI did look into this and as far as I know they’re still looking into it.”
Eagar: “Into that part of it, that element?”
Isenberg: “Sure.”
Just saw this story on a TV station in Florida. I hope that proof is given that one of the reasons he ASSAULTED Ms. Fox is because she mentioned the gay bar… Then maybe the justice dept. will charge him with a hate crime in addition to the other charges. This story is proof that cops are getting out of control.
My wife and I would like nothing better than to see Perez go to jail… leaving his family to live on the streets because of his dysfunctional macho ego.

This video surely shows that he threw Ms. Fox into the wall, the audio is quite clear when her face hits the wall. He used too much force in slamming her into the wall, she is barely a 100 pounds and was slung around like a rag doll, if that isn’t excessive force, then we need to re-write the law!

Sorry but I don’t see anything related to a gay oriented assault. The charges of excessive force seem warranted as a consequence of her being thrown against the wall. Even so, I doubt very much the cop realized she would get hurt like that.
If we as a gay community continue to find opportunity to trump up charges willy nilly, it will undermine those clear cases where gay hate is part of the crime.

I have to agree with Chuck and Roger. She was drunk and upset. You can’t jerk away from an officer. Clearly resisting. It is policy for the officer to hold her arm because she could fall on her own, especially as drunk as she appeared in the video.
First off for those that say the officer was not at fault, You are wrong.. He was, even though she was at fault for possibly resisting arrest, but still the officer had no right to sling her around like a rag doll nor slam her face into the concrete wall nor had used such excessive force on someone that size. And for the officer who allegedly did this should have the shit beat out of him the way he did to her, cus that is absolutely insane, and for the other officer that allowed it to happen by just standing around, he should be placed on desk duty. 1. Cop didn’t need to throw her just because she jerked away. His partner could have grabbed her other arm and they both could have lead her to the patrol car. If she was some enormous, out of control crackhead dude or meth head, then maybe they could have slammed the person to the ground in case they had a gun or something. I wonder what a guy like that would do to his daughter or wife if she got out of line.

I think what he did was completely wrong…gay or not….but I do not think it was intentional. I think he was being a little rough to show her he had control. but i dont think his intention was to throw her into the wall like that. If that had been his intention he wouldnt have acted so concerned after the fact.

And, in order to correctly represent Ms Fox, her friends are homosexual, and the way the article is phrased makes it more than slightly obvious she is not. And, in the view point of an actual lesbian, that cop is a douche, because, if you actually watch the full video, as presented by Fox News, she passed the sobriety test, as shown my the clip where she successfully walked in a straight line and turned around and walked back to her starting point, completely balanced.

It sounds to me like Roger is an angry cop that is defending police brutality. What this pig did was horrible, regardless of whether the woman was gay, supported gays, or was straight. If he did it because she was gay that just shows that it was intentional, which warrants a harsher sentence than if he had done it by “accident”. It’s obvious from looking at the video that he intended to hurt her. She pulled away, yes, and it looks like he was gripping her way harder than he needed to. Cops who are disrespectful do not deserve respect, and if they are being abusive to you, you have a right to defend yourself from their assault, and it seems like that is what she was doing by jerking away, the only defense she had from him digging his fingers into her arm. This is just sick, and the cop should get prison time for this.

Once upon a time I was arrested because drug paraphernalia was found in my boyfriends car (wasn’t mine) and the charges were later dropped, but before they could put me in the car they had to have me searched, as a policy to protect officers from false charges male officers are supposed to ask a female for permission before searching them, and are required to call for female backup if the suspect is not comfortable with it. Whether she was drunk or not she didn’t start acting upset until this officer searched despite her objections. He’s lucky she’s not accusing him of molestation. And if she was being uncontrollable maybe the other officer should have stepped in.
Oh yes, I had to stand in my boyfriend’s driveway in handcuffs waiting for a female officer to arrive and search me.
