I’m not trying to beat this public sex thing to death, but I couldn’t resist posting the following e-mail I received last week from one of the four men arrested in the bathrooms at NorthPark Center recently. I’m withholding the defendant’s name, because Dallas Voice doesn’t typically identify people charged with misdemeanor crimes. Here’s the full text of the e-mail:
I was one of the four people arrested and charged with indecent exposure at North Park Mall last week. I strongly believe that I was wrongly charged. The statements given by the police did not match what happened. The cop was standing with his face up against the door of my stall and peeping through the gap while making oral sex gestures to get me aroused. Of course I’m a gay man so I get aroused. Now, tell me who was the indecent one? The one sitting in the stall or the one being a peeping tom outside? Even my attorney shook his head and said that the sting effort was not for people like me.
I understand their effort is to catch sexual predators. However, if I was a predator then the cop did not need to become a predator himself. Also, if the cop cannot tell the facts as they happened then doesn’t that mean that they didn’t catch the right person? So in the end, they caught someone who they can frame to look like a sexual predator and a danger to the public.
On top of that, as I and another accused person were being taken to Dallas County jail, while I was answering questions to one cop, another cop in the back seat blurted out, “He even talks like a fag.” I found that derogatory slur very offensive. It’s like saying to an African American, “He even talks like n—–.” This showed me that these cops were very homophobic and they were just out targeting gay people and not to catch the real sexual predators.
At the station, as the two cops were deciding who would do the report for who, the peeping cop looked at the second cop and said that he will fill out the report for me and he will add extra “special comments” to get me since I did not cooperate with their story.
There was a video recording of the sting. It will show the cop invaded my privacy by being a peeping tom and making lewd gestures. They are afraid to tell the public this part of the story because the public would be appalled to know that a cop can come up and peep into people’s stalls to elicit sexual responses. It seems to me that the cops are the predators and they are targeting the gay community. If they put an attractive woman making sexual gestures in front of a heterosexual man while his pants are down then most of them will get aroused and be charged with indecent exposure, too.
Please let me know if you want to discuss more details about this story. I am terrified at the thought of going into a public restroom. If there is no camera recording and no other witnesses around, a cop can make up a story to charge me because he thinks I’m gay, even if all I do is just wash my hands. It will be my words against his. This time at least I had a witness and a video recording.

Bathroom stalls have only one use. This isn’t the cops fault. I hope you serve time and become a deterrent for other “pigs” that seek sex in the bathroom.
Don’t know much about the people in this case, but when I was in Florida it was typically married, preachers, city counsel, and the like that were caught in the mangroves. Dallas has two bath houses there is no need for non-closeted folks to hang out at the mall/parks.
Sorry, but if someone was peeping into my stall I would find it creepy. I would also tell them the stall was occupied. If they continued making gestures I would use my cell phone to call the cops.
Restroom sex might be hot in an adult video but in Northpark? Oh puhleeze!
I have to say that the cop could/would only have arrested the suspect if the suspect had responded in a way that fit the behavior he was lookign for.
Had the suspect shouted “get away!” then I doubt if he would have been arrested.
Basically the cop was the cat and you became the mouse when you responded the way he wanted you to.
I would not be surprised if the cops entrapped the suspect; I also do not doubt the homophobic slur that was allegedly made.
But the suspect should have decided to “not play the game.” Then this would not have happened to him.
The “victim” went there to have sex. Enough said.
No, that’s not “Enough said.” The “victim” was entrapped, which is against the law and should not be tolerated. The cop was the catalyst for what happened. And there is NO excuse for the comment that “he even talks like a fag.” Does he think he’s some kind of a hero for entrapping an unarmed man in a private stall? Dallas is too caught up in trying to power plays. Cops shoudl be out protecting peopel from violent criminals, but they’re too chicken to do that.
I agree with the bulk of the comments on this page after having read the story twice over. Meaning – the guy became the guilty “predator” the minute he whipped out his wanker – “This stall is occupied sorry!” would have been a much better response. Sorry guy. Thanks DPD.
What if the arrestee had sprayed the cop with pepper spray when he came and peered into the stall and made lewd gestures? Would he have been charged with assaulting a police officer? Come to think of it, that might be a good way to end both the questionable behavior on the part of men seeking sex, AND the questionable behavior of police officers entrapping these men. Pepper spray the hell out of them.
Okay, let’s use some common sense here: If i’m at Northpark Mall and in the stall to “take a poop” (since i’m assuming that’s what he claims he was doing since urinals are for the other)…
If I was on the thinker and a guy, even a very handsome guy, came to my stall and peeked inside making gestures…I would not think, “Oooh, hot.” I would be thinking, “Um, I’m in the middle of my BM, my pooper is dirty, the smell isn’t so great, LEAVE ME ALONE.”
I would not think, “Hmmm…let me stand up, get some toilet paper, clean up and let me respond to these oh-so-sexy looks and come-on’s.
The only thing that makes sense to me is that this guy was in the stall, pants down NOT using the bathroom and waiting for someone to “get things started” and then got caught.

I have to agree with Israel. The only time I go into the stall in a public place is to take a dump. And it probably will not be an environment for “getting it on” while I’m stinking up the place. Something doesn’t sound right in the arrested guy’s story. But I am glad he says in his story that the cop was peeking through the opening in the stall. That is a good warning for everyone to tell those types of weirdos to go away and let you finish your business.
I think Israel pretty much hit the nail on the head. I think he properly has it all figured out. This guys story just doesn’t make sense. Probably trying to cover his ass, no pun intended, because of the humilation from his friends seeing his picture blasted all over the televison. Pepper has an interesting thought. Would work both ways, deter the cops and the others seeking sex while your taking a crap.
