‘Ex-lesbian’ mother warned she could lose custody if she continues to violate court orders

RUTLAND, Vt. — A Vermont judge has denied a Virginia woman’s latest attempt to deny visitation rights to her former lesbian partner.

On Jan. 28, Family Court Judge William Cohen also warned Lisa Miller, of Winchester, Va., that her custody of the 6-year-old child could be in jeopardy if she continues to violate court orders.

Cohen also denied a bid by Janet Jenkins, of Fair Haven, for primary custody of the girl and ordered that she get five weeks of custody in the summer.

Miller gave birth to the girl in 2002, when the two women were joined in a civil union. They split in 2003, and the child has been at the center of a legal battle closely watched by national conservative and gay-rights groups.

After the couple split, Miller said she was no longer a lesbian.
